Class Action Suit Filed Against Sprint Nextel

A Texas law firm today filed a class action suit against Sprint Nextel. The suit alleges that Sprint Nextel illegally placed their antennas on electrical towers without permission. Sprint received permission from the electric company, however according to the lawfirm, the easement given to the electric company by landowners to install towers on their land only covers electrical transmission, not other types. The suit claims that if this was the case, rights to install cellular antenna were not the electrical company's to give. The suit has been filed in Kansas, where Sprint Nextel is headquartered. No date for trial has been set yet.

They laid out the easement infringement pretty clearly so it must be factual.

Sprint tried the same thing down the Florida Turnpike claiming that the local Counties had no jurisdiction because the road was technically state property. Well they were wrong and had to disassemble a number of towers until the proper permitting was accomplished. The towers were horizontal for almost 2 years and 2 of them had to be moved almost a mile.

I would believe the original article and actually the FCC has regulations supporting this type of co-location.

I have to correct one item, it was T-Mobile that built the towers and had to take them down. It wasn't Sprint.

Yeah, the Fl turnpike runs right by my house in the Kissimmee/St Cloud area of Florida. If I'm not mistaken doesn't the state of Florida itself own a few towers on that stretch that they lease out? I could've sworn Sprint leases from them by my house...

The state has built a number of towers along the pike as a lot of telecomm companies who sold the rights to site mgt. companies and Sprint leases space on a lot of them. Some of the rents go for almost $100K a year in the southern areas of the state.

A few years ago the state gave the rights of their towers to M/A Comm in return for a new public safety radio system for FHP and other state agencies. M/A Comm leases the slots out and they split the revenue with the state.
