Lemon Law Comparable Phones

Ok I have been patient but I think I have reached the end of my rope.
I am on my 4th LG VX 8700 in 2 months and this one is no better. You cannot turn the volume up all the way without the phone's ear piece getting very distorted and sounds like it is cracked.

1. How do I get someone to give me a different phone to use? I really love the look of the phone but I find that I hate talking on it because of the tinny and usually distorted sound.

2. What would a comparable phone be considered? I don't want them to give me some POS Samsung or Generic phone.

Opinions? This is not like me to do this but I am really frustrated. I've even resorted to switching ESNs back to my old RAZR v3m just because the sound is better but that defeat...

Well usually after you go through 3 of one phone they will replace it with something different for you. Just be nice about it, and request it. Usually it is up to Verizon as to what it will be replaced with, but it will be something comparable. They might even give you a choice between a couple different models.
