I see no merit to that suit. People CHOSE to buy the Ipod knowing fully well they could have loaded it with MP3 formatted songs and moved them to another brand. If they were dumb enough to subscribe to a proprietary format thats not Apples fault.

why is this even an issue? convert the f*cking .aac file and bam, .mp3. If you can't do that, you shouldn't be talkin' to a lawyer.
You can even convert in iTunes. You're not forced to buy the music from iTunes... you can import mp3's and still leave them as mp3's. WTF???!!!
