I am glad to say that finally someone realizes the point that I had been trying to make for the past 3 months that I have been on this forum and someone has decided to take legal action. Verizon because of your "Great Business" tactics you now got a whole lot of customers against you. There is a way to make honest money and there is a way of cheating people. Hopefully something good will come out of this for the consumers this time because since Verizon has came out with this phone they have been sucking thier customers dry. Maybe then once again they will realize that good business is the means of making your customers happy and being honest. By the way where have all the VZCSR's been? Kindly keep in mind that Microsoft has been sued repeatedly and successfully to remove spyware from WinBlows and each time has had to pay fines for it, give discounts to existing customers, and give customers spy-free versions of the OS if requested. Lawsuits are sometimes the only recourse consumers have to force autocratic companies to pay attention to what their customers want.

I must agree one point posted in this topic.
Customer Stupidity.
Customer Stupidity is the biggest killer of an industry. At the rate which technology grows, there are always those that do not understand it. A giant chunk of these lawsuits are from the uneducated. These lawsuits are also from those that expected something and did not care to read/learn/ask about the product or feature. We started carrying the v710 when it was available. The first question out of my mouth was "Will it sync with a pc?". The first answer I received was no. I didn't see anything on the box NOR in the motorola issued propaganda that claimed the v710 would link with anything other than the bluetooth accessories.

The carrier has the right to lock out certain features. Other carriers limit ring tones/games on some handsets so consumers must buy the tones/games from them. Does this mean those people should sue because they didn't get all of the ring tones that they could have gotten if they bought the handset "unbranded" directly from the manufacturer?? ๐ No. Read the description from the VERIZON website. Since the service you are getting is from VERIZON. They can lock out whatever features they like, for better or worse.

i never said that, fisrt off i was replying to the comment that this phone CAN'T sync. of course the carrier has the right to do what they want i personally have not been blocked from anything i can view any website dowload any ringtone i want and i was with the old ATT plan but lets not go there........once again i was just responding to the comment that this phone CANT sync, which i proved it can per the manufacturer

Technically it does not say what method it uses to sync...Bluetooth or via Data Cable. One thing I noticed is that it mentions the Bluetooth profiles "headset/carkit and DUN". If I am not mistaken OBEX is the one needed for file transfer, what is DUN used for? The fact that the OBEX profile is not listed on the manufacturer website just further shows people did not do enough research before buying. ๐

well i personally have no need for "sync". so i personally dont know the details BUT i use a moto phone from ATT and am able to send pictures to my PC via bluetooth.... which i guess is the "laintiffs" complaint if the phone cant sync via bluetooth than thats fine but the phone is able to send and receive per bluetooth and for VERIZON to block that is F***ed up in my opinion anyway and i am pretty sure alot of people agree........

I agree that it may not be right. But they have an easy cash cow with "GetItNow". Having file transfer enabled via bluetooth on their handsets would make paying for that service pointless. They are in the business to make money. I realize it's not the greatest thing for the consumer, but a lawsuit is just pointless in this case. The people want a feature that was never meant to be used on Verizons network with this phone. If you want to hit Verizon in the pocket book, you move to a different carrier, not join in with the rest of the lemmings on a lawsuit.

You're missing the point...the phones does NOT have the capability, that profile is not on the handset. It was never meant to be on that particular handset. It's all about business decisions, and to my knowledge, that decision was a good decision as far as the immediate future is concerned(GetItNow feature). Whether it is good for the distant future is disputable.

DUN stands for Dial up Networking which is basically what allowas the cell phone to be used as a wireless modulater/demodulator, or modem.
And you're not mistaken, the OBEX profile is the one in dipute. OBEX stands for Object Exchange which is what allows files to be tranferred (games...

Your list there clearly states that it has the ability to sync with a pc with optional Mobile Phone Tools... so it clearly states it's not included.
Enough with the Bluetooth already, everybody knows it can't sync with a computer to transfer pictures (which in all honesty is what this is all about), that was known from day 1, so out of all the people who bought the phone, I'm willing 75% at least knew that was disabled.
This lawsuit however should be interesting, because contracts between Game developers and Verizon Wireless make it clear that Verizon needs to make sure they prevent the sharing of Get It Now applications. And of course people are going to say that's just greedy old verizon, but let's remember someone needs to be paid...

Without file swapping, which is what we'd expect, the advertisement is an abuse of the phrase then, which constitutes false advertising. At least there is a case for false advertising...

It seems that ATTWS ran a series of ads claiming the most towers which was obviously false. Cingular reps are always saying that Verizon, Sprint and the other CDMA carriers will ultimately be forced to switch to GSM. It seems to me that those are examples of the integrity of other carriers.
ATTWS had price plans that were never intended for publication but were used to keep people from churning. ATTWS was also sued in a class action suit over coverage claims in their one rate plan.
