Hi guys,

I'm looking for an example of a contract you use between your store and the customer. I know several stores have them and they state if the customer cancels before 180 days then the store has the right to charge the customer or something to that effect.

If any of you have a contract like that and would be willing to share, would you please PM me and I'll give you my email address.

We have one we use that incorporates more than just a below cost agreement. PM for a copy.

It's basically an early term agreement, stating what additional costs will be incurred per line should they cancel before 180 days go by.

Most customers actually react rather well to it once you explain why it is in place. Our store also waives said fee if the phone is returned in good condition (just the phone, they dont need the box or anything)

My question is this. Most of the time the cancellations are because of non payment. In that case the phones ESN will be locked to the non payment account. How do you get around that and make the phone of use for anything?

Considering the agent is the one who lost the money subsidizing the phone in the first place I would be curious about this one too. Of course with GSM I don't have to worry about that but now with CDMA I might.

I'm not quite sure how it works, but I do know that when we take their information we have both their address and their Drivers license, so I would assume we bill them and if they refuse to pay they go into collections. Our store hasn't been opened a year yet so we haven't heard about this yet.

Once your service is canceled, the ESN will be ubnlocked again. While the account is in limbo, which is past due and send to collections but not terminated just yet, the ESN lock goes into effect. After everything is "z'd" out, you can reuse that phone on a different account or whatever else (provided it is not on the lost or stolen list.
