that sounds like a truck driver's hours, not just one day, but all week long. Oh, yeah, I forgot, truck drivers are not protected under the fair labor act like you guys are...And I know some of you will dispute that, but, it is true, we are not under the fair labor act, kind of sucks. Look at it this way, you are not losing sales and commissions while you are in the back room taking break, your check should be bigger.... 😁

Oh, it can happen. All it takes is a business that thinks it can get away with it for awhile plus lax labor law enforcement.

Friend of mine used to work for Wal-Mart awhile back... they regularly paid him late, like two or three weeks late on average. This happened several times, not an isolated incident. He eventually got fed up and quit, and said he never heard of any authorities calling the store on it. Guess Wal-Mart's too big.

FLA does cover break time and an adult can be required to work many more hours than 8. Only seven states currently mandate break time.

Of course most reputable firms provide breaks and if so the law regulates its compensation. The issue of breaks for adults is a contractural one.

The original poster said he was in CA, which is where I live. I believe that CA does indeed have mandated breaks.

Paid 10-minute rest period for each 4 hours worked or major fraction thereof; as practicable, in middle of each work period. Not required for employees whose total daily work time is less than 3 and ½ hours.


Administratively issued Industrial Welfare Commission Orders.


Uniform application to industries under 15 Orders, including agriculture and household employment.
Excludes professional actors, sheepherders under Agricultural Occupations Order, and personal attendants under Household Occupations Order.


Additional interim rest periods required...
