Bought a phone off Ebay, came in a plain Motorola box must be a refurb. But Motorola says there's a software update but the phone is out of warranty, is there anything I can do to get the update?

Take it to a direct store and the store technician can upgrade it. A word to the wise: a phone purchased from ebay has no warranty and if it dies on the operating table the will not replace it.
