SAN JOSE, Calif. (AP) — Complaints over Apple's use restrictions and recent software update for the iPhone have erupted in two lawsuits alleging Apple and its carrier partner, AT&T, engaged in illegal monopolistic behavior.
Two separate lawsuits were filed Friday in San Jose — one in federal court and the other in state court and both seeking class-action status.
The federal case accuses the companies of unfair business practices and violations of antitrust, telecommunications and warranty laws. The state case raises some of the same allegations.

If this phone would have been any other phone, say from Motorola, or Samsung, that we would not be having this conversation at all.
Some phones are CDMA some phones are GSM, should lawsuits be filed by customers of each Wireless company because a phone they want is a GSM phone and they are on a CDMA network ran company?
I know we are talking about a "monopoly", but the defense to head off the "monopoly" talk shouldn't make it there for the mere fact that not every phone goes to every carrier. This phone is getting attention because it is the first one by a popular well known company.

As for the lawsuits, I am sick of them; like the person who is suing Apple for $1M because she did not get the $200 discount. If the phone was a flop, you wouldn't be seeing these frivolous lawsuits, but they seem to be popping up every day.
Everybody was complaining about Verizon locking down Bluetooth 3 years ago. Now, Verizon handsets have a full BT stack, and the most innovative phone like this one is all locked up.
