Lawsuit accuses Apple, AT&T of monopoly with iPhone

SAN JOSE, Calif. (AP) — Complaints over Apple's use restrictions and recent software update for the iPhone have erupted in two lawsuits alleging Apple and its carrier partner, AT&T, engaged in illegal monopolistic behavior.
Two separate lawsuits were filed Friday in San Jose — one in federal court and the other in state court and both seeking class-action status.

The federal case accuses the companies of unfair business practices and violations of antitrust, telecommunications and warranty laws. The state case raises some of the same allegations.

listen, apple chose ATT to give the iphone too because it was going to let apple do whatever the hell they wanted. the hacked iphones is just the same as taking a game boy and hacking it. it violates the warrenty and the end user agreement for their software. ATT just doesn't want anyone trying to go thru warrenty on a hacked phone. the other thing is that ATT's network is ATT's. not verizon's, sprints, not , T mow Bile. To keep the structure of their network they can do whatever they want to keep it from failing. this is from someone who uploaded the new itunes version with a hacked phone without reading anything on the internet, tv, newspaper, etc. surprised it from san fran where I'm surprised that any capitalist business is still ...

As I totally agree with your argument, in reality, the explanation to why this lawsuit is egregious is a lot simpler than that...

If this phone would have been any other phone, say from Motorola, or Samsung, that we would not be having this conversation at all.

Some phones are CDMA some phones are GSM, should lawsuits be filed by customers of each Wireless company because a phone they want is a GSM phone and they are on a CDMA network ran company?

I know we are talking about a "monopoly", but the defense to head off the "monopoly" talk shouldn't make it there for the mere fact that not every phone goes to every carrier. This phone is getting attention because it is the first one by a popular well known company.

It's also BS because it's the first of a series. This model can't be used on anything but at&t. Mac's couldn't run Windows software without an emulator for YEARS and that wasn't a monoploy. Hell, there'll even be an unlocked version introduced in Europe shortly. The organizations bringing these lawsuits need to be fined.

I agree 100%. Frivolous lawsuits are whats wrong with this country....

I remember a lady filing a lawsuit against McDonalds for not warning her that her Coffee was hot.

Or the people who sued a bluetooth manufacturer because they were not told that the loudest setting could cause hearing damage.

This whole thing is ridiculous, I don't understand why people would sue over this. If you want the phone then switch if not stay with your current carrier and the phone you have. Just because you want your cake and eat it too, doesn't mean ATT or Apple need to bow to your every whim. I don't see any lawsuits filed because you can only use the LG Chocolate at Verizon or because you can only get a Whopper at Burger King. I would like to say to ALL people with these silly lawsuits...STOP CLOGGING OUR COURT SYSTEMS WITH STUFF THAT DOESN'T MATTER AND GET A LIFE. 👿

I am very impressed with the iPhone and had a chance to mess with it last week for a while. It was disappointing that it was not released for 'all carriers' as originally announced by Apple, and painful to watch the screen refresh speeds on the slower network.

As for the lawsuits, I am sick of them; like the person who is suing Apple for $1M because she did not get the $200 discount. If the phone was a flop, you wouldn't be seeing these frivolous lawsuits, but they seem to be popping up every day.

Everybody was complaining about Verizon locking down Bluetooth 3 years ago. Now, Verizon handsets have a full BT stack, and the most innovative phone like this one is all locked up.

What market are you in? The data on the iPhone I used was pretty good considering that its edge. Didn't see any refresh screens or lag. Everyone that's saying that the phone is crap really hasn't used one. I like it but will never buy first gen of any Apple or Microsoft product. They tend to let the consumer do QA for them instead of making sure the product works right.
As far as the lawsuit, things are getting out of hand in this country. There is soon going to be lawsuits when a supermarket lowers the price on soda a week after it's on sale. The main problem exposed is that the manufactures making the public forget that it's the service that matters, not the "new, cool phones" that the manufactures pump out every month. Support th...

Support the company who gives you the best possible service not the one who comes out with a one off product that doesn't fit your needs anyway.

No, main problem is the manufacturers pump up the public with what they can sell, and then what they can put on a specific network turns out different.
