i was in a store today and was inquiring about an upgrade. att online and on the phone said tough luck. fyi, i am only eight months into contract. the sales rep in the store told me i could get an exception upgrade for 18$. and gave me option of any phone i wanted. she did say that i would have to sign another 2yrs, but that is ok w/me. just to let you know i am not happy w/the phone i got and was really just looking to buy a new phone outright, but she informed of the exception upgrade. my ? is, is this true?

Yes it is true. Make sure you go back and talk to her she offered it to you she has to honor it. CCARE cannot honor anything verbally said by a rep in a store and vice versa. So go back to the point of offer.

A couple of things that you will need to know about an Exception Upgrade. First is that Exception Upgrades can only be approved by a Corporate store, or by the Credit and Activations department. If you were in a COR store, there should be no problem, but if it was an Authorized Dealer, they will need to go through the C&A department for final approval.

Secondly, and a lot of reps leave this little tidbit out, is the price of the phone. Yes you know that there is an $18 Upgrade fee and you will be signing a new 2-year contract on the line. The price of the phone is also $75 more than it is in a regular upgrade. For example, on a regular upgrade the LG Shine is $124.99 with a $75 mail-in-rebate. On an exception upgrade, the Shine is $199.99...

say that we have to charge a $75 fee on top of the price of the phone. I know in MyCSP it had it in their for like a month...but they got rid of that. So we don't do that. If we let the customer upgrade early it is just that...a early upgrade.

If it is over the phone our system we use to order the phones through direct fulfillment has the exception pricing its basically how they used to charge for 1 year contracts. We cannot offer standard upgrade to customers just 6 mos into contract we can offer exception pricing online or the nokia 2610 39.99 replacement option.

To me 6 months into contract when they fully knew they could get insurance on a phone is just rediculous. 4.99 a month is a great premium for Insurance. It is not AT&T's responsibilty to make sure they dont drop their phone, leave it on the bumper of the car, drop it in soup, etc.
