Adding a New Phone to an AT&T GSM Contract
My current billing from AT&T is based on an expired contract from the original AT&T. It is GSM service. They will not offer a new contract because my rates are just too good! My Nokia 6820 is starting to fail. I have been told that the current GSM phones require the "orange"/64K SIM not the "blue" smaller capacity SIM and therefore I can not connect a more current phone. Furthermore I have been told that my account will not even accept the entry of a new SIM number. Is this correct and therfore should just buy a phone on ebay? Or should escalate my issue within AT&T?

This is true. You have a rate plan from a company that essentially died 3 years ago. The only way to keep your plan would be to get an unlocked phone and transfer your sim card into it. A "New ATT" Sim card would not be recognized on that plan and you would be forced to move into a new plan. You have been fortunate that ATT has not forced people off of their old plans, but if you want a new phone at a discounted price, you will either have to move to one of ATT's current plans or change carriers. Either way, you will not be able to carry your rate plan with you.

If you want to keep your rate you will have to get an unlocked phone. Which isn't a bad thing at all. www.plemix.com
You could get some awesome phones just make sure they have gsm 850/1900.
If you choose this route, make sure to take in consideration the additional cost of buying an unlocked phone vs. a subsidized phone. It could verywell be cheaper to just get on a new plan and take the cheaper subsidized phone. But who wants what both your neighbors have. Get something sweet.

My current rate plan is so good that I can write off a $300 phone in 6 months or less when compared to the cost of the same service level under a new contract. My only concern is identifying a phone that will work with my SIM card. I can always pay a few dollars to have it unlocked. Any ideas on how to identify the phones that will work. Ebay here I come!

be careful of ebay. Go to the site I showed you www.plemix.com it has fair prices and should be close to the brand new prices from ebay sellers. Any phone on that site that has gsm 850 and gsm 1900 frequencies will work. If it is listed as quadband you will be fine. If you could tell me what kind of features you want I'd be happy to recomend some too.
