I can upgrade on 12/18/08 and I wont an iphone, I am sure that that close to xmas they will be hard to find, what would it take for them to let me do it sooner?

abosolutely nothing. it's a zero tolerance rule. any agent assisting with getting the iphone earlier than the system will allow at the $199/299 pricing will be fired. but if you want to pay the $399/499 pricing, then by all means go ahead.

at least you do not have to pay the full price of the phone for 599.99 or 699.99 for the 16gb. If you want it so bad early then pay the 399.99 pricing. Why is it such a big deal to have it now?

Well unfortunately you will have to buy it at the 399.99 exception price if you do not want to wait. Customer cares hands are tied and you can thank the agreement between apple and at&t for that.
