What do I do?

I found a Sony Phone and was wondering if I can use this under my name by switching out the sims card or if they will know it's not my phone? What do I need to do

The right thing to do is see if you can locate the owner of the phone by contacting some of the people in the address book.

All of us normal people--possibly jaded and made cynical by useless whiney customers--would keep the phone and put our own SIM cards in it.

Heh, someone told me the police can track it down and if anything if activated on the acct I believe they use to be able to see "stolen device."

I'm sure that's possible, but proving it was stolen would be the key. Just using a phone you found wouldn't be theft.

Again though, the right thing, crime or no, is to try to return it.

Did the phone have a SIM in it already? Is there a contact list? Is it an active phone? One should take every effort possible to return a lost phone to its owner. If it seems new and recently lost, you could also take it to an AT&T store and see if they are able to locate the owner.

This would be the right thing to do. You must, however, make that decision for yourself.

As far as knowing if it is your phone or not, yes it is possible. Each phone has a distinct serial number. If the phone is reported stolen and the customer pushes to see if it is being used and you are using it on your account you can be identified. However this will most likely only occur if the customer has involved the police.

Agree - try to find the owner. Think of the poor SOB who is stuck without a phone, potentially looking at paying full retail because he is not eligible for an upgrade. Besides, remember that a scout is Trustworthy, Loyal, Helpful, Friendly, Couteous, Kind... (you get the idea).

I do not even have ATT so it's pointless for me to keep it and it appears everything is erased on it. I looked through it and there is nothing on it, I guess ATT can locate without this info?

Yeah...with the IMEI number of the phone.

There is no Sim Card? I would dial 611 and tell them that I just found this phone and would like for the owner to give it so see if they can call the Home# if one is listed and get the acct owner and to call you to get the phone. Or return to the AT&T store.
