If you already had the $30 unlimited data plan then yes, you are grandfathered in.

If you upgrade from one smartphone to another (i.e., from BB to iPhone or BB to a Windows Mobile PDA) you are still eligible for unlimited data. I am not sure what happens if you upgrade to a non-PDA device, but if you move off the unlimited plan you CANNOT go back.

AT&T’s new data plans certainly have gotten their fair share of press over the last couple days. There are two articles in particular that got us thinking, and we would like to throw our two cents into the ring. So here are our thoughts: AT&T, your improved data plans suck. Hit the jump for the rest of our rant.
It’s not because there is a lower data cap on the new plans… we can get our heads around that. We don’t like it, but we understand it — unfortunately, it is the way things are moving. However, the way in which AT&T is going to charge smartphone users for the data they use is just dismal. The fact that using 2 GB of data while signed up for the 200 MB Data Plus plan will result in a bill of $150, while usi...

The fact that using 2 GB of data while signed up for the 200 MB Data Plus plan will result in a bill of $150, while using 2 GB with the Data Pro plan will only total $25 is infuriating…and a mathematical/accounting anomaly. Reuters reporter, Felix Salmon, asked AT&T’s executive director of media relations, Mark Siegel:

M.S.: “No.”

so you also agree the $18000 Verizon data bill was wrong correct??? they should have simply automatically put the cutsy on unlimited right??? ( see link below ) How is that "infuriating" wh...

all the link describes is how outrageous your bill could become if you fail to switch to an adequate data plan for your needs and continue to excessively go over your data plan ignoring the notifications!!! that is partially the consumers fault, and at times possibly fault at the pos for failing to properly explain the data plans to the custy and set appropriate expectations. if the writer of the article and your self feel its so ridiculous that using 2gb on the 200mb plan will cost $150 vs $25 than i must say you are unfamiliar with how all cellular plans work that are not unlimited and pretty much always lead to the possibility of outrageous bills. can you tell me one good reason at&t should have responded any other way to “Is there...

If one was grandfathered in and does NOT have to have a data plan(from sept 09). Will an upgrade to another smartphone mean u have to get the data plan?

Yes. If you have a Smartphone, you must have a data plan. However, this was made more affordable for the low-end personal user with the DataPlus 200MB Personal at $15. Of course, this plan will not allow the full discounted price on equipment.
