question.....with legal stuff and the merger.....

seeing some of these threads and listening to lots and lots of customers cingy is doing a lot of things that are raising eyebrows....a customer came in and said she had a agreement 2 yr with attws and just found out that cingy changed everything without notice....i know that by law you are suppose to notify the consumer and give them options on things they can do with a company no longer around or "absorbed" with another.......cingy isn't doing this and i know the bb and the fcc are investagating this because the company i work for has been in contact with the bb and past attws customers.......my question is to all who know cingy better than i do.......when a customer signs a contract and state laws are different in evry state.....and cingy ...

Because the obsorbtion of ATTWS into Cingular does not effect the contract. The cust is still under contract under 1 company. As far as Cingular not living up to up to there end of the agreement,That's something that would end up in court. In other words.....the Cust has to deal with it or pay to go to court? Which do you think is cheaper?

no were not changing any plans ..... not unless a customer comes to a store and wants a new phone then they have to get it through cingular in which tey sign a new contract with cingulars terms and conditions and get a cingular plan ! We are not just changing att cusotmers plans without telling them

As far as I know, most wireless providers have some sort of "merger" clause in the T&Cs. It's the same thing as if the company you got a car loan from was bought out by another company. I'm pretty sure that you wouldn't be able to say "hey, the company changed, so I don't have to repay my loan, right?". Company's merge all the time and there's plenty of examples of contracts moving from company to company. So no, this isn't a "new world" as far as the law is concerned.

yes but there are state laws that do over ride t&c nj being one......

even then, if say the cust lived in Ca at the time of signing, then moved to NJ, they'd still be under contract by the T&C's.

Refer to my car-loan example. I had a loan for a truck with A***** and after a couple of years they were bought up by O***. Guess what! I still had to pay off my loan, even though "my" contract was with A***** and not with O***.

lol....nothing changed on the service other than the name....promo's stayed the same. Its stated in the T&C with ANY company, contracts can be sold or assumed without prior notice. WTf has peeps been if they hadnt heard of the merger?! My grandmother even knew they merged!....lol.

The only way a cust can cancel the account and not have to pay the ETF is if Cingular were remove a promo or change the rate plan. If the change isnt a welcome change and the cust disagrees with the change, then they can opt out of contract w/o an etf.

so lets say they had a 39.99 1000 min free nite weekends.......10 add......they changed it to 39.99 450 19.99 add......no notice....they asked.....have to pay etf.....they say because they can change plans without notice.....so if a contract is bidding by law whose in the wrong ....not the consumer according to the bb.....but listening to every on here seems to say its the customers fault......how?

Or you can luck out like on call I over heard.

-Rep is fighting with cust

-Someone on my team chcuks something at him.

-Rep slams the mute button.

-Rep then yells "what the f***"

-Rep then finds to his horror that mute button had been double tapped and the customer heard everything.

-Later, a supervisor will release the man without his ETF.

in the aws terms and conditions it wrote of assignment, and how you agree that they can assign your account off. Simply this was done, cingular bought all of aws's assets and the contracts were assigned to them. as far as changing terms a change in terms was also agreed upon in the terms and conditions. rate plan changes are done at the customers choice to accept new terms and conditions and extend contracts under cingular.is a very lengthly proccess over the phone, can be done and agreed on thew website or in store, thru all channels it is not forced upon tyhere customers. if done otherwise this is a different story and yes perhaps a waived etf is in order and reverse in monetary disc provided.

That Nation 450 plan would of came with a new phone 😁

We need a credit card to order new phone 😁

Can't really call it no notice when the cust places an order.

I know your not talking about the TDMA Blue cust that are being switched over since 2G Blue never had plans with 10 add.
