But I am on a final written warning for coming back from Lunch to early. Management tells me that if all reps were as good as me they would not have as many frustrated customers. but in spite of that they are sasying they are going to fire me for coming back from lunch to early.

There has to be some other reason behind you being on a final. You dont just go up from nothing to a final for logging in early once.

logging in early means you get paid , what an extra 33 cents, cingular is all about cuuting costs at the lower level, so the execs can continue the cxaviar and martini lunch, breakfast dinner and snack times.

Your manager can pull strings for you. I've been on a final final before...and heard of people on final final finals before: as in, there have been people on an eighth step before. Just talk to your manager, and if he/she is unwilling to go beyond the book, go talk to your area manager. If all else fails, request to be put on another manager's team and get a semi-fresh start with sucking up to your new manager. Though rules seem to be written in stone with cingular, there are ways around everything. Heck, my HR manager got my vacation pushed up for me to a week that was blacked out when I had a family emergency.

Cingular is just obeying the law. They could face large fines from the Bureau of Labor for not providing you with the required lunch period!

I have to call Shenanigans here.
While the law does require that a company allow employees to take time for lunch - there is no law that says an employee must use that time for lunch.
If that were the case - people who use their lunch break for activities other then lunch - would in fact be breaking the law.

Another point that they have to look at is if they do clock back in early that means they have to get paid. Clocking in 5 o6 minutes each day results in almost an hour of overtime which most places dont allow in the first place. So if Cingular is really strict on overtime then that is probably the reason for them being anal about it. Regardless its still stupid though. Who punishes people for wanting to work more?

In the state I work in there are laws that REQUIRE employees to take their lunch break. Cingular will be fined if they let employees work through even a part of their lunch break!

That's wild - I sympathize with what you have been posting lately in regards to your call center.
I hope things work out for you.
Ps. I am imagining a scenario where you have to take exactly X amount of time for lunch. For example, say an hour.
So would that mean that if you take lunch at 11am that you must log in to your station at exactly 12pm?
I am curious - if you logged in early and they write you up - if you log in a split second late - are they as equally unforgiving?

You know this may seem out of line, but why do I get the feeling that most of the existing (Cingular) call centers that are left will soon be outsourced?

unfortunatley its still considered an FLSA violation and the companies hands are tied. cingular or any company for that matter can get into serious trouble for any type of FLSA violation. BTW it is the federal government that mandates FLSA compliance and violators can and usually are prosecuted. unfortunatley for reps they dont usually get prosecuted but the policy is strict for even 1 violation. in my center i think they give you 2 chances to avoid termination. 1st is a coaching, 2nd is FWW and 3rd your out.

I do understand FLSA just saying they over disciplined me and the punishment does not fit the crime. It's like getting a one year prison sentence for a parking violation when you have no prhior record. I am a good employee that they ave made feel like sh**.

This doesn't fall under FSLA. He said he clocked in. FSLA only applies to employees who are working OFF of the clock. Like I said marcus. File a grievance.

File a grievance with your Union. They have no right to put you on a final for that.

That's unauthorized overtime. Of course they're going to be upset about it. It's costing them money.
If you get back to your desk too early, just wait until the 'correct' time to get back to work. Keep a book or something similar at your desk to pass that time.

He does have a point. (Not sure how Cingular's scheduling works) If you're scheduled 30 hours/week, 6 hours a day for 5 days, maybe that's all they want you to work. You coming back early either forces you to go over 30 or have to leave early, putting the rest of the employees in a bind.

That's about as much BS as me getting written up for an acceptable Mystery Shop score! If they're determined to fire you for coming back from lunch early....LET 'EM!! But get it in writing exactly why you're being terminated and have it signed by a supervisor. Then go and attach it to EVERY application that you put in for a new job.
