What is Cingular's policy when the cops confincate your phone?

I just had a customer stop in and asked what cingular's policy is when the police confincate thier cell phone. Apperently he was a witness to crime and the police took his phone to see if it had incriminating photos.

It's been 2 months since this incident occured and the police won't give back his phone (I'm guessing there must be some juicy stuff on it). Anyway he's got the records to prove the cops have his phone. Is thier something he can do to get credit or a new phone, or is this a case of too bad, too sad.

I'm not too sure what can be done about that. Legally, it is his phone, but it has to be held as evidence. The only that that I can think of is that the customer can get a data cable and perhaps have the cops upload the pictures so that the cops can use them as they see fit. I don't think that the cops can keep the phone though unless they have a subpoena to confiscate the evidence. If that is the case, it IS, unfortunately, a too bad, so sad situation. You can probably talk to the sheriff or admin person and see if there is any way that they can get reimbursed for the phone... or if they will pay his phone bill until the phone is released back to the person. i'd suggest having him ask the police department that has his phone call cingular and see if they can work something out.

other than that he's outta luck. unless he has insurance.

my cousin has a friend who's probation states that he's not allowed to carry a cell phone. he got busted with it. and the only thing he could do is file an insurance claim. no waived etf, free phone, credit, etc.

the loss of the phone or his property he would have to makea claim against the department, cingular would not compensate.

My guess is this customer is not revealing the entire story. Usually happens in the case of criminals. If he just had photos they could easily be transferred from the handset. My guess is it is something more than just that.

Oh, I absolutely agree with you. They probably said it was their "friend" to spare themselves the embarassment. At any rate though, whatever the cops have on that phone must be important enough to keep the phone.
