Ca not apply downloaded mp3 as ringtone

I have been able to dowload short and longer mp3 files to my V710 but when i go to the media gallery and select them it does not give me the option "apply as ring tone". Has anyone run into this and found a solution?

SEEM EDIT.. you have the newer software in your cell.. do a search on seem edit and I'm sure you'll find out how to get it working
