New model - Refurb?

I've been holding out on buying the 8100 until the update came out. Now that it's out I have 2 questions:

1. Can I assume that all newly purchased phones (today aug 25) will have this update, or will it take time before they get a new shipment of phones in?

2. If I buy a new phone, is it possible for me to end up with a model that someone returned and they just flashed with the update? I definitely don't want a previously used phone or refurb.

You will never get a refurb when you are upgrading or signing up for service. Refurbs are only given out for warranty swaps or insurance replacements. You cannot assume that the phone will already have the new software, you'll have to wait until another batch of them comes in. You also have to wait until they sell all the ones they already have. But you might as well just get the phone and have a tech flash it, it's better than waiting for a few weeks.
